View Full Version : How long does a buyer have to report a fault?

Hi! I sold an item (polaroid camera) 2 months ago. The buyer emailed me straight away saying the flash wouldn't work. I emailed back telling them that the flash wouldn't work unless there was film inside the camera. I didn't hear from them again, though they left positive feedback, so i assumed all was ok. They've emailed again today saying they've only just got some film and the camera isn't working as the prints won't come out of the camera. They've had the camera for 2 months now, and it seems odd that they've left it this long to test it. They're asking me for advice, but I don't know what to say, as the camera worked perfectly for me. They're saying if the camera doesn't work, then it's obviously no use to them, but am I expected to refund after over 60 days?

I had this problem a few months back with a digital camera (but it was brand new) and they left it about 2 months between messages as well. I just said due to time gone by anything could have happened to the camera whilst in their possession so would not accept a return as it should have been returned at least within 28 days. It is not your fault they have taken so long to check it. It sounds to me like they just don't want it anymore which i think was the case with mine as i heard no more from them.

Thanks for replying. I get the feeling he's not doing something right, but without seeing it I can't tell what. I've replied to him; he basically emailed me asking if I had any advice and if it had happened to me before, and then at the end mentioned if it wasn't working then it's no good to him, so I just replied saying that I couldn't advise as it had always worked for me, and didn't make any further comments. I get the feeling the next message will be a 'please refund' message, and I already feel mean that I'm going to have to say no. But it's been left for too long and I no longer have the money! I was just wondering what would happen if he started a claim or even if the claim would be allowed to be made in the first place. I'd heard of people being able to make chargebacks up to 6 months after if they'd paid by paypal funded by credit card.

It is the buyer's problem if they haven't tested the camera before 2 months passed.
As a private seller, they have no come back on you if an item is found to be faulty after 60 days.
They should have tested it within a reasonable time and didn't.
I would politely advise that after such a long time, there is nothing you can do to help.
The item was sold as used and I assume sold as full working condition?

Yes it was sold as used, and had been working perfectly for me so sold as working condition. I'd only used it a couple of days prior to listing it so knew it was working.

I would definitely repeat that info along with what I said in my last post - seems your buyer has maybe damaged the camera or has had second thoughts about buying it :(
